On January 7, 2008, Momentive Performance Materials Japan LLC submitted an application to the Ministry of Commerce requesting the succession of the anti-dumping tax rates applicable to the above-mentioned anti-dumping measures by the Japanese General Electric Toshiba Silicone Co., Ltd. The company advocates that after absorbing and merging Japan General Electric Toshiba Silicone Co., Ltd. in April 2007, it will be renamed to Motuo Hi-tech Materials Japan Co., Ltd. and renamed the company after production, sales channels, raw material suppliers, management, pricing strategies, etc. No changes have been made, and relevant proof materials such as company name change registration certificate, main raw material supplier comparison form, company statement, etc. have been submitted. On June 20, 2008, the company submitted supplementary documents and related notarization and certification documents issued by the Chinese embassy in Japan according to the requirements of the Ministry of Commerce.
The Ministry of Commerce informed the original applicant of the anti-dumping investigation on the above application. In the specified time, the original applicant did not express disagreement on the application of Momentive High-tech Materials Japan Co., Ltd.
After examination, the Ministry of Commerce considers that the existing evidence shows that the name change of Japan's GE Toshiba Silicone Co., Ltd. complies with the relevant Japanese laws and regulations. Before and after the company name change, the management of the product under investigation, sales channels, production equipment, and major raw material suppliers The customer base and pricing strategy have not changed.
Based on this, the Ministry of Commerce decided:
1. Momentive Performance Materials Japan LLC succeeded by GE Toshiba Silicones Co., Ltd. in the anti-dumping measures of primary-form dimethylcyclosiloxanes. The applicable 14% anti-dumping tax rate;
2. The surveyed products exported to China under the name of GE Toshiba Silicones Co., Ltd. are subject to the applicable 22% anti-dumping tax rate applicable to “other Japanese companiesâ€.
This announcement has been implemented since August 19, 2008.
